3、“车损自负”是霸王条款根据《消费者权益保护法》第26条规定，停车费发票背面的“车辆损坏概不负责”说明字样，属于典型的“霸王条款”，消费者有权说不。
几类特定情况下停车场无赔偿责任
法律界人士表示，收费停车场是否对停放车辆负有保管责任、车辆受损后停车场的责任如何划分，这些问题仍然存在争议。如果发生车辆刮擦，首先是肇事者的责任。但很多时候搞不清楚是什么人划伤的，作为提供有偿服务者，停车场对车辆受损应承担相应责任。
如果是免费停车，停车场仅在其对保管车辆的毁损、灭失存在故意或重大过失的情况下才承担损害赔偿责任。但如果是商场、饭店等消费性场所提供的“免费停车”，应是商家提供给顾客的一项配套服务，是有偿商业行为，在该情形下停车场不能定义为免费停车场，对停放车辆的损失承担相应赔偿责任。如是机关、企事业单位等非消费性场所的免费停车场，停车场无故意或重大过失不承担赔偿责任。
此外，车主将车辆停放在停车场，如果欲一并就车内物品与停车场达成保管合同，需另行就车内物品与停车场缔结保管合同，并交纳相应的保管费用。如果既未将车内的贵重物品交付停车场管理人员，也未将贵重物品放置车内的情况明确告知停车场管理人员，该情形下车内物品不应在赔偿范围内。□宁波晚报 记者 房伟 通讯员 王作正 范凯红
