因被答辩人诉我公司网络购物合同纠纷一案，答辩人作为第三人，现依法作出如下答辩意见：
针对被答辩人的诉讼请求，答辩人认为被答辩人属于职业打假人，以合法形式掩盖非法目的，属于无效合同，驳回被答辩人所有诉讼请求，理由如下：
第一，被答辩人在多地有多起诉讼，其并非真实的、普通的消费者，是职业打假人。被答辩人开设的“XX旗舰店”分别购买20XX年7月23日、8月16日、8月24日、8月24日分四次购买同一产品“XXXXX”共计X元，该产品单价仅为X元，并向XX市XX区法院提起诉讼。通过被答辩人的行为完全可以推断出其为职业打假人，被答辩人购买商品并非生活消费需要，而是作为获取非法利益的手段，被答辩人违背了法律的公平原则及立法宗旨，如被人大量随意滥用，将会在一定程度上影响市场经济的健康有序发展。因此，被答辩人在答辩人网店购买商品的行为不能适用《消费者权益答辩状(网购合同纠纷)律师拟定版本保护法》，答辩人不应承担如此高额赔偿。
第二，被答辩人在未同答辩人进行相关询问并确认的基础上，直接在答辩人网店直接购买，且短期内购买大量答辩人产品，后直接提起诉讼，要求依据《消费者权益保护法》的规定进行赔偿，上述事实足以推定被答辩人购买商品的行为并非为生活所需，而是将其作为一种获取非法利益的手段，其行为属于以合法形式掩盖非法目的，根据《合同法》第五十二条之规定，被答辩人的行为应属无效行为，理应驳回被答辩人所欲诉讼请求。
第三，对于被答辩人要求“退还货款”的请求，不符合《产品质量法》、《消费者权益保护法》规定的退货情形，其请求于法无据。
综上所述，被答辩人作为职业打假人，在未与答辩人协商确认的基础上，直接购买大量购买商品，并以此作为答辩人出售的产品与网店上宣传的产品不一致的依据，要求根据《消费者权益保护法》的规定进行赔偿，属通过合法形式掩盖非法目的的行为，应属无效合。故此，请求法院驳回被答辩人的全部诉讼请求。
